Electronic communications consent
This Electronic Communications Consent (“E-Consent”) applies when you use the APPNAME mobile application, website, or related services operated by Noxti Money LLC (“Noxti Money,” “we,” “us,” or “our”) and when you agree to receive legally required or transactional communications in electronic form. This document supplements our Terms of Use and Privacy Policy. Please read it carefully and retain a copy for your records.
Agreement to receive electronic records
By checking the appropriate box, tapping “I agree,” submitting a request through APPNAME, or otherwise affirmatively indicating your consent where required, you agree that we may provide you with any notices, disclosures, records, or other information relating to your use of APPNAME or to loan-matching services (collectively, “Communications”) in electronic form, to the extent permitted by law. Electronic Communications may be delivered by email to the address you provide, through in-app messaging, by SMS where you have opted in and where permitted, or by posting on our website or within the app.
You understand that certain third-party lenders or service providers may separately require electronic consent or paper disclosures for their own products. Their terms control with respect to credit products they originate. This E-Consent does not replace any lender-specific electronic disclosure or signature process.
Categories of Communications
Depending on your interactions with APPNAME, electronic Communications may include: (1) service and account-related messages (e.g., password resets, security alerts); (2) disclosures required by the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and similar state laws; (3) privacy notices and updates; (4) marketing communications where you have provided legally required consent; and (5) responses to inquiries you initiate. We may combine categories in a single email or message where appropriate.
Hardware and software requirements
To access and retain electronic Communications, you need: (1) a device with Internet access; (2) a current web browser or the supported version of the APPNAME mobile application; (3) an email account capable of receiving HTML email and attachments; and (4) sufficient storage to retain Communications or the ability to print them to PDF. We may update minimum requirements from time to time; material changes will be described in our Terms or through a notice posted within APPNAME.
Requesting paper copies
You may request a paper copy of any Communication we are required to provide in writing by contacting [email protected] or writing to Noxti Money LLC, 100 Westwood Ave, Columbia, MO 65203-2874. We may charge a reasonable fee for paper copies where permitted by law. We will disclose any fee before fulfilling your request.
Withdrawing consent
You may withdraw consent to receive electronic Communications that are not legally required in non-electronic form by contacting us at the address above. Withdrawing consent may limit our ability to provide certain services through APPNAME. If law requires that we continue to send certain notices (for example, adverse action notices through a lender), those may still be delivered as required by the lender or by law.
Marketing opt-out is separate: use the unsubscribe link in marketing emails, our Unsubscribe page, or follow SMS opt-out instructions. See also our Marketing Practices disclosure.
Updating your contact information
You are responsible for maintaining a valid email address and, if applicable, mobile number on file. You should promptly update your contact information through APPNAME settings or by contacting support. We are not responsible for delivery failures caused by spam filters, full mailboxes, or inaccurate contact details you provide.
Electronic signatures
Where you electronically sign documents through integrations or links provided by lenders, those processes are governed by the lender’s agreements and E-SIGN disclosures. Your tap, click, or typed name may constitute a legally binding electronic signature to the extent provided in those documents.
